Terms of Trade

These terms apply to every consultation, treatment, product, package and gift voucher supplied by Asylum Advanced Aesthetics. By booking, paying or attending, you agree to them.

1About these terms

These terms apply to all services and products from Asylum Advanced Aesthetics, Addington, Christchurch.

1.1

Definitions

"We", "us" and "the clinic" mean Asylum Industries Limited, trading as Asylum Advanced Aesthetics, and its technicians. "You" and "the client" mean the person receiving treatment or buying a product or voucher. "Treatment" means any service on our current price list, including inkOUT non-laser removal, laser tattoo removal, laser hair removal, Tight and Bright, skin rejuvenation and laser facials, carbon and signature facials, pigmentation treatment and EMS body sculpting.

1.2

Precedence

Where a treatment-specific consent form conflicts with these terms, the consent form applies to that treatment.

1.3

Consumer law

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or the Code of Health and Disability Services Consumers' Rights, except where the law allows us to do so for business purchases.

2Consultations, eligibility and consent

Every client completes a consultation and signed consent before their first treatment of each type.

2.1

Age

Clients must be 18 or older. We may ask for photo identification.

2.2

Medical disclosure

You must disclose your full medical history, medications, supplements, allergies, pregnancy or breastfeeding, recent sun exposure and any previous treatment on the area. You must tell us of any change before each appointment. We are not responsible for outcomes caused by information you did not disclose.

2.3

Patch tests

Laser and IPL treatments may require a patch test at least 48 hours before your first full session. We will tell you if one is needed.

2.4

Right to decline

Your technician may decline, postpone or modify any treatment if they believe it is unsafe or unsuitable. This includes active infection, tanned skin, recent medication changes or signs of intoxication. Where we decline on clinical grounds at the appointment, no cancellation fee applies unless the reason was disclosed late or not at all.

2.5

Informed consent

We explain the expected results, number of sessions, risks and aftercare before treatment. You may ask questions and withdraw consent at any time, including during a session.

3Bookings and deposits

A booking is confirmed only when we accept it and any required deposit is paid.

3.1

Booking requests

You may book online through our booking system. Every booking is reviewed by our team, who may adjust the duration, time or technician before confirming. We will contact you if a change is needed.

3.2

Deposits

New clients, and all bookings over 60 minutes, require a deposit of 25% of the treatment price at the time of booking. The deposit is credited to your treatment on the day. We may waive or vary the deposit at our discretion.

3.3

Contact details

You are responsible for giving us a current email address and mobile number. Confirmations, reminders and portal links are sent to these details.

3.4

Reminders

We send a reminder before each appointment as a courtesy. Not receiving a reminder does not waive the cancellation terms below.

4Cancellations, rescheduling and no-shows

We need at least 48 hours' notice to cancel or reschedule without charge.

4.1

How to cancel

Cancel through your booking confirmation link, by email or by text message. Notice is timed from when we receive it.

4.2

Discretion

We may waive or reduce any fee in this section at our discretion, for example for illness, bereavement or emergencies. Please tell us as early as you can.

4.3

Package sessions

A missed or late-cancelled session from a prepaid package is forfeited instead of charged.

4.4

Repeated no-shows

After two no-shows we may require full prepayment for future bookings.

4.5

Clinic cancellations

If we cancel or reschedule, we will offer the next available time or a full refund of any deposit. We are not liable for other costs you incur.

5Pricing and payment

Payment is due in full on the day of treatment, before you leave the clinic.

5.1

Prices

All prices are in New Zealand dollars and include GST. Our current price list is published on our website. Prices may change, but the price confirmed at booking applies to that booking.

5.2

Quotes

Treatments priced by area or session count, such as inkOUT and laser tattoo removal, are quoted at consultation. A quote is valid for 3 months.

5.3

Accepted methods

We accept EFTPOS, credit card, cash, Afterpay and online payment. We do not add a surcharge to in-clinic payments made with New Zealand-issued cards.

5.4

Unpaid amounts

Future bookings may be held until any outstanding amount, including cancellation fees, is paid.

5.5

Afterpay and accounts

Afterpay purchases are subject to Afterpay's own terms. We do not offer accounts or other pay-later terms unless agreed in writing.

6Treatment packages and courses

Prepaid packages are paid in full at purchase and must be used within 3 years.

6.1

Use

Package sessions are for the named client and the treatment and area stated on the package. Packages cannot be transferred to another person or exchanged for cash.

6.2

Expiry

Sessions not used within 3 years of purchase expire. We may extend this for medical reasons, pregnancy or clinic-caused delays.

6.3

Early termination by you

You may end a package at any time. We refund the amount paid less the full single-session price of each session already used, less an administration fee of $50.

6.4

Clinical termination

If we stop your course because further treatment is unsafe or will not help, we refund the unused sessions at the package rate, with no administration fee.

6.5

Course length

Session estimates given at consultation are a guide. Some clients need more sessions than estimated. Additional sessions are charged at the current price.

7Gift vouchers

Gift vouchers are valid for 3 years from the date of sale, as required by the Fair Trading Act 1986.

7.1

Expiry shown

Every voucher, printed or digital, shows its date of sale and expiry date.

7.2

Redemption

Vouchers may be used towards any treatment or product. The recipient must still complete a consultation and meet the eligibility terms in section 2. A voucher cannot be exchanged for cash, and unused balances remain on the voucher until expiry.

7.3

Deposits and fees

A voucher may be used to pay a booking deposit. Cancellation and no-show terms in section 4 apply, and any fee is deducted from the voucher balance.

7.4

Lost vouchers

We can reissue a lost voucher where we can verify the purchase record.

8Results, aftercare and your responsibilities

We provide every treatment with reasonable care and skill, but results vary from person to person and cannot be guaranteed.

8.1

Variable results

Outcomes depend on skin type, age, health, lifestyle, ink type and depth, and how closely aftercare is followed. Session numbers and results given at consultation are estimates, not promises.

8.2

Aftercare

You will receive written aftercare instructions. You must follow them, including sun protection, wound care and activity limits. Results affected by not following aftercare are not grounds for a refund or free treatment.

8.3

inkOUT

inkOUT uses the TEPRderm protocol and creates open treated areas (tegulae) that heal over several weeks. Scabbing, weeping and temporary redness are expected. Complete removal can take several sessions, usually spaced at least 8 weeks apart, depending on the treatment method and how your skin heals. Some texture change or pigment change in the skin may remain.

8.4

Laser and IPL

Laser and IPL treatments carry a risk of blistering, temporary pigment change and, rarely, scarring. Risk rises with recent sun exposure, fake tan and some medications.

8.5

Concerns after treatment

Contact us straight away if you have concerns about healing. Clients on a tracked protocol should also upload photos through the treatment portal. For signs of infection or a serious reaction, see a doctor or call 111.

9Refunds and consumer guarantees

We do not refund a treatment because you changed your mind or did not get the result you hoped for, but your rights under the Consumer Guarantees Act 1993 always apply.

9.1

Services

Under the Consumer Guarantees Act, our services must be carried out with reasonable care and skill, be fit for the purpose you made known to us, and be completed in a reasonable time. If a service does not meet these guarantees, we will first offer to remedy it, for example with a corrective session at no cost. Where it cannot be remedied, or the failure is serious, you may be entitled to a refund.

9.2

Products

Skincare and aftercare products must be of acceptable quality. Faulty products are replaced or refunded. Opened products are not refunded for change of mind, for hygiene reasons.

9.3

How to raise it

Tell us within 14 days of the treatment where possible, with photos if relevant. This helps us assess and fix the issue quickly. It does not limit your legal rights.

9.4

Refund method

Approved refunds are paid to the original payment method within 10 working days.

10Treatment portal, photos and media release

Clinical photos form part of your treatment record. We use them in marketing only with your separate written media release.

10.1

Clinical photos

We take before and after photos of the treated area to plan and assess treatment. These are stored securely in your client record.

10.2

Treatment portal

Clients on a tracked protocol, including inkOUT and EMS body sculpting, receive access to our online treatment portal by email link. You may upload photos and messages there. Portal messages are not monitored outside clinic hours and are not for emergencies.

10.3

Media release

Photos or video are used in marketing, social media or training only where you have signed our media release. Marketing images never show your face or name unless you agree to this specifically.

10.4

Withdrawing consent

You may withdraw your media release at any time by writing to us. We will stop new use straight away and remove images from our own channels. We cannot recall material already printed or shared by others.

11Privacy and health information

We collect and hold your personal and health information in line with the Privacy Act 2020 and the Health Information Privacy Code 2020.

11.1

What we collect

Contact details, date of birth, medical history, consent forms, treatment notes, photos and payment records.

11.2

Why

To assess suitability, deliver safe treatment, track results, contact you about your care and meet our legal obligations.

11.3

Storage and sharing

Records are stored securely with New Zealand and overseas cloud providers that meet recognised security standards. We do not sell your information. We share it only with your consent, with your health providers when clinically needed, or where the law requires.

11.4

Access and correction

You may ask to see or correct the information we hold about you at any time.

11.5

Retention

Health records are kept for at least 10 years after your last treatment, as required for health information in New Zealand.

12Conduct, complaints and general terms

12.1

Conduct

We keep a safe, respectful clinic. We may end an appointment or decline future bookings if a client is abusive, threatening or under the influence of alcohol or drugs. Full charges apply to an appointment ended for these reasons.

12.2

Companions and children

For safety during laser treatment, children and companions may not enter the treatment room without our agreement.

12.3

Complaints

Raise any complaint with us first, in person or in writing. We will acknowledge it within 5 working days and aim to resolve it within 20 working days. If you are not satisfied, you may contact the Health and Disability Commissioner or apply to the Disputes Tribunal.

12.4

Liability

Except where the law does not allow it, we are not liable for indirect or consequential loss, or for outcomes caused by information you did not disclose or aftercare you did not follow.

12.5

Changes to these terms

We may update these terms. The version published on our website at the time of your booking applies to that booking.

12.6

Governing law

These terms are governed by New Zealand law.
